"The Department Of Justice’s filings argue, effectively, that class
action litigation is the wrong mechanism
to address the myriad business and copyright questions at issue in the
sweeping agreement. It also
 presents the related question of whether the court, in fact, has the
actual authority to approve the ASA
 in the context of the specific federal statutes raised and adjudicated
in the case."
